- Scope of Agreement
This Terms and Conditions Agreement (TC) applies to the party or parties (“You”, “Your”) who make use of any Web Hosting, Search Engine Optimisation (SEO), Design Services or Bulk E-Mail Services (the “Services”) from Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) (Pty) Ltd (“Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)”).
The terms and conditions which follow are necessary to ensure that we may continue to provide the best possible service to you, whilst at the same time satisfying our legal and ethical responsibilities. Failure to follow any term or condition will be grounds for immediate account deactivation without notice. Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will be the sole arbiter as to what constitutes a violation of any of these provisions.
Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) reserves the right to add, delete, or modify any provision of this TC at any time without notice.
The domain: webdesignhub.co.za and any of it’s sub-folders and sub-domains contain information which may be outdated and obsolete, if this is the case, we will rectify this at our own discretion as we see fit or as we notice or change information on our own website during the course of it’s live state. If you may have noticed outdated information and feel the need to inform us, you may kindly do so by emailing firstname.lastname@example.org.
- Technical Support
Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will provide You with technical support for setup of your account and access to basic site administration, such as FTP and cPanel, at no additional charge.
Email Support is available Monday to Friday from 8:00am to 5:00pm Excluding Public Holidays

Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)’s target response time to technical support requests is four hours. The response time depends on the complexity of the enquiry and current support request volumes.
Out of Business Hours:
Email Support can be submitted but will be actioned the next business day.
Phone support: Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will endeavor to respond to critical issues when they arise.
Clients who request Services to be completed outside of business hours, will be charged at R850 per hour (minimum 1 hour) unless it is a technical issue at Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd).
- Website Availability
Objective: Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) aims to achieve 100% Website Hosting Services Availability for all customers.
Remedy: Except under the conditions mentioned in the section below, if the Website Availability of customer’s Hosting Services is less than 100%, Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will issue a credit to You according to the following table:

The credit will be calculated based on the monthly service charge for the affected Services, but You will not receive any credits under this TC in connection with any failure or deficiency of Website Availability caused by or associated with:
circumstances beyond Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)’s reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, armed conflict, embargo, fire, flood, strike or other labour disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, virus attacks or hackers, failure of third party software (including, without limitation, ecommerce software, payment gateways, chat, statistics or free scripts) or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of this TCA;
failure of access circuits to the Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)’s Network or it’s upstream providers, unless Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) solely cause such failure;
scheduled maintenance and emergency maintenance and upgrades;
DNS issues outside the direct control of Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd);
issues with FTP, POP, IMAP, or SMTP customer access;
false TCA breaches reported as a result of outages or errors of any Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)’s measurement system;
customer’s acts or omissions (or acts or omissions of others engaged or authorized by customer), including, without limitation, custom scripting or coding (e.g., CGI, Perl, HTML, ASP, etc), any negligence, wilful misconduct, or use of the Services in breach of Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)’s Terms and Conditions;
e-mail or webmail delivery and transmission;
DNS (Domain Name Server) Propagation.
outages elsewhere on the Internet that hinder access to your account. Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) is not responsible for browser or DNS caching that may make your site appear inaccessible when others can still access it. Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will guarantee only those areas considered under the control of Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) those are; Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) server links to the Internet, and Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)’s servers.
Please note: Server downtime is not recorded and no credit is issued during scheduled or emergency system maintenance. Outages caused by the actions beyond Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)’s control including, but not limited to DoS attacks or other forms of intrusion are excluded from the uptime/downtime calculations.
To guarantee optimal performance of the hosting infrastructure, it is necessary for Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) to perform routine maintenance on the servers. Such maintenance often requires taking Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) web and email servers off-line, typically performed during off-peak hours. Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will give you advance notice of maintenance requiring the servers to be taken off-line whenever possible. Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) reserves one hour of Service unavailability per month for maintenance purposes.
Such unavailability is not included nor taken into account in the Website Availability calculation.
- Credit Request and Payment Procedures
To claim a credit as contemplated in paragraph 3, send an email request to email@example.com. You must provide your Account ID and all dates and times of server or network unavailability.
If the unavailability is confirmed by Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd), credits will be applied within two billing cycles after Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)’s receipt of customer’s credit request. Credits are not refundable and can be used only towards future billing charges.
Notwithstanding anything to the contrary herein, the total amount credited to customer in a particular month under this TC shall not exceed the total project and service fee paid by You for such month or project quote. Credits are exclusive of any applicable taxes charged to You or collected by Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd).
Credits are Your sole and exclusive remedy with respect to any failure or deficiency in the Website Availability as contemplated in paragraph 3.
NOTE: Under no circumstance will funds be transferred back to a customer should they cancel their services with us. There are exceptions to our discretion if we have sufficient evidence by email and other forms of text messages of bad service or unfortunate events that have effected the customer because of any neglect on our part. We aim to do our best and 99.9% of the time we succeed – If you were not happy with our services and have paid upfront for services, you will not be liable for a refund if you have not brought it to our attention that our services were unfavourable in the past.
Should any credit request be successfully granted from our bank account into your nominated bank account for any reason whatsoever, we will ONLY do so during our next billing run. This billing run starts as of the 20th of each month and completes no later than the 28th. Note that there are sometimes and has been exceptions in the past depending on our workload that the run may be extended for a few short days. If so, please allow 5 to 7 Additional Business days on the aforementioned indicators to accommodate your credit payment.
- Maintenance Procedure
Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will do its best to announce on its website any scheduled maintenance at least 24 hours prior to the scheduled maintenance.
Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) reserves the right to perform emergency maintenance without any prior notification, should it be deemed necessary to protect and maintain the security and integrity of the Service
- Projects, Initiation, Scope of Work, Deposits and Service Fees
For All Projects, the following will be applicable:
Please ensure that all information is true and correct when onboarding with us. Any misinformation or information not communicated to us prior to quoting can result in the cancellation of our services to you without refund if we are in development or nearing development finalizations and this decision remains to our sole discretion.
A tiered structured deposit is required before we will start any work. Our Tier structure works as follows: Tier 1: Projects’ Invoice value up to R 10 000 is 100% payable up-front. Tier 2: Projects’ Invoice value over R 10 000 will require R 10 000 deposit and any balance over this amount but not exceeding R 25 000 is payable on completion. Tier 3: Projects’ Invoice value over R 25 000 will require a 50% Deposit and the final balance on completion of work, this final tier applies to any invoice amount for R 25 000 and over.
By paying this deposit You acknowledge liability for the payment of the remainder of the quoted amount on finalisation of the quoted project plan.
Services will commence once the deposit or invoiced amount was received.
Finalised projects will only be published once the remainder of the quoted amount was received.
We may in some cases help our customers with work which was not intended or expected and this remains to our decision and discretion if we choose to continue or halt services at any time NOT RELATING to the quotation and/or invoice.
Unless explicitly quoted and invoiced as such, Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will not be held liable for the content of your website once you, the customer and/or any person(s) who You have nominated, have access to your website and/or any electronic service/project we offer. Not only does this include the actual content which ourselves, you and/or your nominee has created but also additions such as blogs, products, pages, etc. to your website. It remains the responsibility of the client/nominee to create, edit and publish their own content once they are able to do so. As an exception, Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) may quote the client to load the content of the site if required.
Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) will not provide development-related support for web applications, scripts or components from third parties, or those developed by You or your 3rd Party, unless otherwise agreed between Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) on and You or after written confirmation of acceptance of a separate quotation and/or invoice for such a project or scope of work.
Should your hosting services NOT BE with us (Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) – We take no responsibility for your files, databases, entries or data as a whole or in pieces (files) of any sort. Even in the event of the duration of development; if for example your website undergoes a security breach during the development, WE CANNOT accept responsibility as we are not the owners of the files and therefor, have no control over the security type and quality of the security on these servers. We ONLY BUILD AND DEVELOP WEBSITES AND ECOMMERCE STORES in this or a similar matter. Unless explicitly stated on our quotation or invoice, if your Hosting Services for your Website, Ecommerce Store, Database, Mailboxes, etc. is not with us as your Service Provider, we are not liable for any of your data loss in the event of any data breach, hack, malicious action by any type of software and/or person(s) or company(s) OR or “Act of God”. We therefor also reserve the right to charge for any work which may need rectification or additions as a result of such an unfortunate event if requested by you. PLEASE ENSURE THAT YOU HAVE A GOOD HOSTING PROVIDER
Regarding Updates on Themes and Plugins: We will NEVER update any plugins or themes during or after a build or project, UNLESS it is required in order to complete a project. Updating Themes and Plugins is a serious matter and as such, we will ALWAYS charge a fee for updating, even during a build or after signoff of a project or if stated explicitly when requested by you, the customer. Rest assured that the date in which we installed the plugin or theme, that this date, the correct, most up to date, and working version was installed – So as to not cause confusion to WordPress Update Notifications (which occur almost daily), your website at the time of building and sign-off DOES NOT require updating and will always be handed over in its correct form. SO PLEASE DO NOT confuse WordPress Update Notifications when we hand over a project or build (website or ecommerce store).
With regards to any written content, images and media – We will normally provide royalty free content if required. If you provide the media and content, we TAKE NO RESPONSIBILITY for any legal proceedings or cases which may arise from content which exists on your website. As the website owner, you are responsible for the content on your website so please make sure that you are not plagiarising any content from any other website or person or company. It is illegal to do so and it is not our job to check your content for you, it is only our job to supply you with website and ecommerce design & development services and as such, we will not have any responsibility here.
For Subscription Services, the following will be applicable:
Annual Subscription fees are payable in advance.
Monthly Subscription fees are payable on the 1st of each month.
If you ONLY have Website Hosting with us, we will not take any responsibility for any 3rd party website designers and/or developers work or edits and changes that they may apply to your files, databases, emails, DNS settings, etc. We do provide daily backups for 30 days but they are a VAS (Value Added Service) and NO RESPONSIBILITY will be taken for restoration of any database. PLEASE ENSURE that if you employ or initiate services with ANY 3rd Party Designers, Developers, etc. that we will not be liable for any loss of data or bad practice of that Designer or Developer and as such we reserve the right to terminate your services. This case also applies in the event of any mal activity as we have to protect our servers from malware, hackers, viruses and so on.
If “Free Changes and Maintenance” is included in your Hosting Package that you ordered with your Website Design & Development order; these changes and maintenance hours ONLY become affective once the website is complete and signed off. This VAS (Value Added Service) is ONLY applicable to existing content, meaning that only existing content can be edited or amended. Any new content, pages, posts, products or functionality for design and/or development is to be quoted separately as a new and separate service.
There are no roll-over hours allowed for Maintenance Plans or SLA (Service Level Agreements). If your plan allows: for example 2 Hour Edits per month, those 2 Hours are to be used in that given month and expires on the last calendar day of that month, therefor, forfeiting those 2 Hours or their prorated balance if they we not used or requested to be used by the customer. The only exception for Roll-Over hours are on the full package offered and in this event, only rolls over for one month, therefor allowing a 30 day grace period for hours not used to be used the following month.
Service will be interrupted on accounts that reach 7 days past due.
Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) may temporarily deny service or terminate this Agreement upon failure of You to pay charges when due.
Unpaid Subscription Services will be removed from our servers, 14 days past due. No backups of these Subscription Services will be available after removal.
It remains Your responsibility to make backups before initiating cancellation or migration procedures.
Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) (Pty) Ltd may at times, with reasonable notice to customers, revise or amend its current subscriptions, shared and dedicated hosting offerings relating to price, features, traffic allocations and disk sizes.
Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) make use of various payment methods, amongst others, EFT, Debit and Credit Cards and Debit Orders.
It is your responsibility to use the correct nominated Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) bank account and payment reference when making payment, in order for payment to be allocated correctly.
This price increase only affects Cash Deposits inside the branch. We therefore urge customer to please make use of the ADT (ATM) to make cash deposits. There are no bank fees on ADT cash deposits. If you are forced to make a cash deposit inside the branch, please include R50 extra for bank fees. Payments not received in full (invoice amount + bank fees), will not be processed.
Should You choose the 24-month contract, we require that you complete our online debit order form that will enable us to deduct the monies directly from the bank account You provided. You acknowledge liability for the payment of the entire contract fee.
- Project and Service Cancellation
In the event that You or a party in relation to the project (3rd Party) cancel, cause any delay and/or no communication is received for more than twenty-eight (28) calendar days, (e.g. failure to provide sufficient content relevant to the Service after requested by Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd)), or failure to pay the remainder of the quoted amount within seven (14) calendar days from due date, for any project that requires a deposit, the following will be applicable:
We retain the amount of any advance deposit made for your project;
Furthermore, we will rightly assume that you have abandoned or unprioritized the project. We WILL cancel any outstanding work to be completed due to non-correspondence or lack thereof after the abovementioned period. We do our best to help all of our customers in the time stipulated for completion, however, we accept NO RESPONSIBILITY for any completion delays on work not being completed or able to be delivered if twenty-eight (28) calendar days have passed without a customer or 3rd Party response by email (paper trail) with the content, documentation or information requested. We again mention that in this event, we will assume that the project is abandoned or has moved priority and will treat the project or service as completed and signed off. In certain special cases, we will allow exceptions or extensions (if communicated and requested by email), however, this is at our own discretion based on credibility and reliability of prior dealings and will be dealt with on a case-to-case basis.
It is NOT OUR RESPONSIBILITY to follow up or chase outstanding content or information or any outstanding matter with you, the customer or a 3rd Party. PLEASE INSURE that you have calendar dates set up to insure and remind you to get your content or information to us in time.
An invoice for all work completed up to the date of written notification, including expenses not exceeding the original quoted price;
All finalised work will be stored for thirty (7) calendar days after which it will be deleted permanently from our servers without any recourse to recover or restore.
In an event of such permanent deletion, all agreements between the parties become null and void with Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) reserving all rights.
In the event that you cancel Your Monthly or Annual Subscription Services for any reason, the following will be applicable:
One (1) Calendar month notice must be given in writing;
The notice month subscription fee must be paid;
All Subscription Services will be terminated on the last day of the notice month.
Prematurely cancelling Annual Subscription Services will result that You forfeit, to Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd), all remaining Annual Fees paid in advance.
- Website Export
You have the option to export your site to another hosting platform. We will provide you with a .zip file containing the editor preview HTML, CSS, and images of the site in a format that can be installed on your external web server.
The .zip file we provide you will contain the editor preview HTML, CSS, and images of the site that is formatted to be installed on web servers and will work without needing the website editor. Since we use dynamic serving of content by device, we will generate three folders of HTML/CSS—one for each device.
We will not continue to track exported site stats since events tracking of the sites impressions and events will be removed, however Google Analytics will remain if installed. Dynamic features, such as personalization, contact forms, and other features will stop working and not be available on the site. All tracking will remain on the site on our platform, but not on the exported site.
Keep in mind that you will not be able to make edits to the exported site using the website builder (after exporting onto your own server); you will need to make additional edits through the HTML and CSS.
Features not included in export:
Some widgets and features will not be available in the .zip file export:
Store: The store will not export into your .zip file, but you can export your products into a .csv file through the store control panel.
Blog: The blog will not export in the HTML of your site, but it will be available in the .rss file.
404 page: The 404 page will not be exported.
Password Protected Page feature: The password protected pages feature will not be exported, however the pages will be exported.
Personalization triggers: Rows and popups created using personalization rules will be exported, however the triggers associated with these rules will not be exported.
MapBox UI: Maps will not use MapBox to display location data on your exported site. Instead, exported maps will use OpenStreetMap to display locations previously set through MapBox.
Features that appear but will not work in export
Some features will appear on the exported website, however they will not work on the site: OpenTable widget and Email option in the Share widget
FAQs about the export:
Will Web Design Hub t/a Datatel Communications & Printing Services PTY (Ltd) be able to assist with updates and installation on other servers? Unfortunately not. We take great care to make sure our Dashboard is always up to date and complies with the latest technology. Because the website will not be on our platform, we will not be able to render this service.
Will custom widgets work on my exported site? Custom widgets that are already placed in the site will be exported.
Will paid images work on my exported site? Paid images that are already placed on the site will be exported.
What can I not do with the deliverables of the export tool? After you have exported the site, you are not allowed to un-minify the JS/CSS. You also cannot copy our template designs and sell them.
Does the export tool export the desktop site or all three views? Since we use dynamic serving of content by device, we will generate three folders of HTML/CSS—one for each device.
Will all my images be optimized? We will only export the images you have used on the desktop site. We will not export every optimized image size (images that appear on tablet and mobile will not be optimized for those views).
Does the export tool export the latest version of my live site or the site in my editor? The export tool will export the live version of the site.
